These Terms of Use ("Terms") govern your access to and use of the FONA website, mobile application, and related calling, messaging, and video communication services (together, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Service. By using the Service you confirm that you meet this requirement and that all information you provide is accurate and current.
3. The Service
FONA provides an application enabling voice calls and instant messaging over the internet, including discounted international and domestic calling rates as advertised on our website and within the app from time to time. Some features require an internet or mobile data connection, and call quality may depend on factors outside our control, including your device, network coverage, and third-party carriers.
4. Accounts
You may need to register an account and provide information such as your name, phone number, and email address to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. Notify us promptly if you suspect unauthorized use of your account.
5. Rates, Billing, and Top-Ups
Calling rates, subscription plans, and bundle pricing are displayed within the app or on our website and may vary by destination and change from time to time. Where the Service involves pay-as-you-go credit, top-ups, or subscription plans, you agree to pay all applicable charges at the rates in effect when the charge is incurred. Purchases are processed through the relevant app store or payment provider, whose own terms may also apply. Except where required by law, credit and payments are non-refundable.
6. Acceptable Use
You agree not to use the Service to violate any applicable law or regulation; transmit spam, unsolicited marketing, or fraudulent communications; harass, abuse, or harm another person; infringe the intellectual property or privacy rights of others; distribute malware or attempt unauthorized access to our systems; or engage in robocalling, telemarketing, or other bulk automated communications not authorized by us. We may suspend or terminate accounts that we believe, in good faith, violate these Terms.
7. Emergency Calls
The Service is not designed to support emergency calls to services such as police, fire, or ambulance. Please use a traditional telephone line or mobile network for emergency communications.

The Service, including its software, design, logos, and content, is owned by FONA TECHNOLOGIES LTD or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
9. Third-Party Networks and Availability
The Service relies on internet connectivity and third-party telecommunications networks to complete calls and deliver messages. We do not guarantee uninterrupted, error-free, or fault-free operation, and availability, rates, and country coverage may change without notice.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by applicable law, FONA TECHNOLOGIES LTD shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the three months preceding the claim.
12. Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have breached these Terms or if required by law. You may stop using the Service and close your account at any time.
